TERMS OF SERVICE

1. Introduction

Open Edge, LLC (“Open Edge,” “we,” “us,” or “our”) operates a public cloud platform for developers at https://open-edge.io/ (“Platform”). By registering, accessing, or using any services (“Services”), the customer (“you,” “your,” “user”) agrees to abide by these Terms of Service (“Terms”).

2. Services Provided

Open Edge provides compute, storage, networking, API access, and server/network metrics as metered services. All resources are billed on a consumption basis, and services are currently in Beta. No add-ons or service tiers exist.

3. User Eligibility and Account Requirements

Users must be 18 or older. Account registration requires a valid email, full name, email verification, and a payment method through Stripe before billable resource creation.

4. Acceptable Use

No spam, malicious software, or illegal US-based activities (including but not limited to child exploitation or illicit drug services) are permitted. Violations may lead to suspension or ban. An explicit resource abuse policy applies and is referenced herein.

5. Billing & Payments

All usage is metered, with rates publicly posted. Billing occurs at each month’s end. Failed payments are retried twice; if not resolved, accounts enter “restricted” status and may be suspended or terminated upon continued nonpayment. Refunds are granted only in cases of demonstrable overcharge or Open Edge billing error, not for dissatisfaction with the service.

6. Data Handling and Privacy

Users may voluntarily upload data, including sensitive or regulated information, but Open Edge does not intentionally process such data. Google Analytics and Cloudflare Analytics track general service usage. Stripe is used exclusively for payments. On request and absent outstanding balance, Open Edge will purge all user resources and account data, except for historical accounting and analytics records.

7. Service Levels and Warranty

There is no guaranteed SLA. Services are provided “as-is,” with no warranty of uptime, fitness for purpose, or error-free operation. Open Edge accepts no liability for downtime, data loss, interruption, or similar incidents.

8. Support & Service Modification

User support is provided via website contact and ticketing. Response time is typically within one business day. Open Edge reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time.

9. Legal Jurisdiction & Dispute Resolution

Wyoming state law governs these Terms. Disputes will be resolved through binding arbitration.

10. Termination & Suspension

Accounts may be suspended or terminated for any violation of these Terms, illegal activity, fraud, or abuse. Upon account suspension, user resources are held for 30 days, after which all data may be permanently erased unless the issue is resolved.

11. Acceptance & Changes

Agreement to the Terms is required at registration. Continued use means acceptance of any updates, which will be announced via the Platform.

12. Miscellaneous

Open Edge is not currently subject to additional regulatory regimes (e.g., GDPR, CCPA), but this may change as needed.
